Litigation before the Administrative and Constitutional Courts

In the planning, environmental, state aid and regulatory fields as well as public enterprises/projects we advise both the public sector, particularly Länder (States), towns and local authorities and companies and special funds owned by the public sector as well as private individuals on conducting litigation as well as at the preliminary stage before a dispute becomes litigious.

Our diverse experience in litigation extends from enforcing infrastructure projects such as motorways and railway lines against actions taken by third parties, through to judicial proceedings to review the constitutionality of laws, through to zoning plans and disputes about building and environmental permits through to issues about granting and recovering subsidies for publicly-sponsored projects and enterprises.

We also advise the public sector and its special funds on enforcing or defending actions concerning the allocation of assets, both in and out of court. The experience we have gained from this advice at the interface between public law, private law and administrative and civil procedural law also benefits our clients in private enterprise.
