GSK Update: Bans for Diesel Cars – Traffic Restrictions in German Cities

On 27 February 2018, the German Federal Administrative Court ruled that bans on German streets for diesel vehicles may be laid down in air quality plans. This paves the way for the competent state authorities to introduce the relevant traffic restrictions in order to comply with the EU emission limit values which have been binding since 2010.

Hamburg and Munich have already declared their intention to introduce such bans on diesel vehicles. More cities are expected to follow, as infringements with limit values are currently being registered in about 70 German cities and municipalities. However, the constitutional principle of proportionality will require exemptions to the bans.
