The LCIA has modernised its arbitration rules through a “light-touch” update aiming at a more state-of-the-art and efficient way to conduct arbitration proceedings.
Main changes were undertaken with regard to the power of the Arbitral Tribunal by introducing, inter alia, an “Early Determination” power to dismiss any unmeritious case at a very early stage of the proceeding. Furthermore, the updated rules are also designed to adapt to the current use of technology by expressly stating, for instance, the primacy of electronic communication and therefore enhancing the overall efficiency of the proceedings.
